Terms of Service — ToursAI

1. Who we are and what these Terms are
These Terms of Service ("Terms") govern the use of the ToursAI application ("App", "Service"), provided by ToursAI — Email: info@toursai.it.
By downloading or using the App you accept these Terms. If you do not accept them, do not use the App. The processing of personal data is described in the Privacy Policy, which forms an integral part of your relationship with us.
2. Description of the Service
ToursAI is an AI tour guide offering:
- a conversational voice guide activated with the wake word "Ehi Guida";
- automatic narration of places based on your GPS position;
- recognition of monuments and artworks through the camera;
- walking navigation to points of interest;
- personalized narrations and a "memory" feature (for registered users);
- 16 languages, offline mode, a 24/7 travel companion;
- a trip planner, travel diary and statistics.
Some cities are available for free; other content or features may require a subscription or purchase (section 5). The Service partly relies on third-party providers (AI, maps, weather, speech synthesis): the availability of individual features may depend on those providers and on your network connection.
3. Requirements and minimum age
You must be at least 13 years old to use the App; users under 18 must be authorized and supervised by a parent or guardian, in particular for street use and any purchases.
4. Account
- You can use the App as a guest or create an account (email and password, or anonymous sign-in).
- You are responsible for safeguarding your credentials and for the activity carried out with your account.
- You can delete your account at any time from within the App: deletion permanently removes the account and all associated data (see the Privacy Policy).
- We may suspend or terminate accounts in case of breach of these Terms, abuse of the Service or legal obligations, with prior notice where possible.
5. Subscriptions, payments, renewal and withdrawal
- Purchases and subscriptions (when active) are handled through the Apple App Store or Google Play (with RevenueCat infrastructure). Price, duration and content of the offer are shown on the purchase page before you confirm.
- Automatic renewal: unless otherwise stated, subscriptions renew automatically at the end of each period, at the same price and for the same duration, unless cancelled at least 24 hours before the end of the current period.
- Managing and cancelling: you can manage or cancel your subscription at any time from your Apple account settings (Settings → [your name] → Subscriptions) or Google Play (Menu → Subscriptions). Cancellation takes effect at the end of the period already paid; no pro-rata refunds are given except as provided by Apple/Google policies or by law.
- Right of withdrawal (EU consumers): for digital content supplied immediately, at the time of purchase you will be asked to consent to immediate performance and to acknowledge the resulting loss of the 14-day withdrawal right, in accordance with the Apple/Google procedures. Refunds under the stores' policies and your mandatory statutory rights remain unaffected.
- Free trial (if offered): at the end of the trial the subscription converts to a paid one unless cancelled before the trial ends.
- Any price changes will be communicated in advance through the stores and will apply from the next renewal; you may cancel before they take effect.
6. Acceptable use
You agree NOT to:
- use the App unlawfully, or to harass, defame or harm others;
- attempt to circumvent security measures, technical limits or access restrictions;
- decompile, disassemble or reverse-engineer the App, except as permitted by mandatory law;
- use the App to generate or distribute unlawful content, or query the AI systems abusively or in an automated way (scraping, bots, non-personal bulk use);
- resell, sublicense or commercially exploit the Service without our written consent;
- use the App while driving vehicles or in situations where it would dangerously distract you.
7. Intellectual property
- The App, its software, trademarks, graphics and original content are owned by us or our licensors and are protected by intellectual property laws. You are granted a personal, limited, non-exclusive, non-transferable and revocable license to use the App for personal, non-commercial purposes.
- Some content comes from third-party sources under their own licenses (e.g. OpenStreetMap data © OSM contributors, ODbL license; Wikipedia texts, CC BY-SA license). Such content remains subject to those licenses.
- AI-generated narrations are provided for your personal use within the Service.
- Keepsake photos you take remain yours; you grant us only the technical rights strictly needed to display them in the App on your device.
8. Disclaimer — please read carefully
8.1 AI-generated content
The historical, artistic, cultural and practical information provided by the App is generated by artificial intelligence systems and, despite our efforts, may contain errors, inaccuracies, omissions or outdated information (dates, attributions, opening hours, prices, anecdotes). The App is a tool for entertainment and tourist storytelling: it is not an academic source or an official information service. Always verify important information (opening hours, tickets, access rules, local regulations) with official sources.
8.2 Navigation and personal safety
- Walking directions are computed automatically from third-party map data and may be inaccurate or out of date (roadworks, closures, pedestrian zones, restrictions).
- Directions do NOT replace your own attention: always watch where you walk, obey traffic lights and pedestrian crossings, and mind traffic, steps and obstacles.
- Do not stare at the screen while walking. Use voice mode and stop in a safe place to check the map.
- The App does not know real-time conditions of dangerous areas, crime, disasters, demonstrations or emergencies: always assess the safety of places yourself, especially at night or in unfamiliar areas.
- The App is not an emergency device or a rescue service.
- Using the App while on the move is at your own risk: you are solely responsible for your personal safety.
8.3 Service availability
The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free or always available: it also depends on network, GPS, devices and third-party providers. Offline mode covers only previously downloaded content.
9. Limitation of liability
To the maximum extent permitted by applicable law:
- we are not liable for indirect or consequential damages, loss of profits, data or opportunities arising from the use of, or inability to use, the App;
- we are not liable for damages arising from incorrect AI-generated information, inaccurate route directions, or use of the App in breach of section 8;
- our total liability to you is in any case limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the claim (or EUR 50 if you paid nothing).
Nothing in these Terms excludes or limits liability for wilful misconduct or gross negligence, for death or personal injury, or any other liability that cannot be excluded by law. Mandatory consumer rights remain unaffected.
10. Indemnity
You agree to hold us harmless from third-party claims arising from your use of the App in breach of these Terms or of the law, except where mandatory law provides otherwise.
11. Changes to the Service and to these Terms
We may modify the App (add, change or remove features) and update these Terms. Material changes will be announced in the App with reasonable notice; continued use after they take effect constitutes acceptance. If you do not accept the changes, you may stop using the App and, where applicable, cancel your subscription.
12. Governing law and jurisdiction
These Terms are governed by Italian law. For consumers residing in Italy, the courts of the consumer's place of residence or domicile have mandatory jurisdiction. For consumers residing in the EU, mandatory consumer-protection provisions of the country of residence remain unaffected. In all other cases the courts of the place where the provider is established, in Italy, have jurisdiction. The European Online Dispute Resolution (ODR) platform remains available where applicable.
13. Miscellaneous
- Severability: if any clause is invalid, the remaining clauses remain effective.
- Assignment: you may not assign your rights under these Terms without our consent.
- Third-party stores: use of the App is also subject to the Apple App Store / Google Play terms; Apple and Google are not parties to these Terms and are not responsible for the Service.
- Entire agreement: these Terms and the Privacy Policy constitute the entire agreement on the use of the App.
- Language: this is a courtesy translation; in case of conflict, the Italian version prevails for users in Italy.
